1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the MyYacht platform, including the website myyacht.me and all related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

Please read these Terms carefully before using our Platform. If you do not agree with any part of these Terms, you must not use the Platform.

2. About MyYacht

MyYacht is a yacht charter coordination and booking platform. We connect guests with yacht owners and operators, facilitating the booking and management of yacht charter experiences. MyYacht acts as an intermediary and is not itself a yacht operator or charter company unless stated otherwise.

3. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Platform under applicable law

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements.

4. User accounts

To access certain features of the Platform, you must create an account. You are responsible for:

• Providing accurate, complete, and current information during registration
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Bookings

All bookings made through the Platform are subject to availability and confirmation. A booking is confirmed only when you receive a written confirmation from MyYacht.

By making a booking, you agree to:

• Provide accurate information about the number of guests and any special requirements
• Comply with all applicable rules and regulations set by the yacht operator
• Treat the yacht and crew with respect
• Pay all fees and charges as agreed at the time of booking

6. Pricing and payment

All prices displayed on the Platform are in Euros (€) unless otherwise stated. Prices include applicable taxes where required by law.

Payment terms, including deposit requirements and payment deadlines, will be specified at the time of booking. We reserve the right to cancel unconfirmed bookings where payment has not been received.

7. Cancellations and refunds

Cancellation and refund policies vary by booking and will be clearly communicated to you before you confirm a booking. In general:

• Cancellations made within a specified period before the charter date may be subject to a cancellation fee
• Refunds, where applicable, will be processed within 14 business days
• MyYacht reserves the right to cancel a booking due to circumstances beyond our control (e.g., severe weather, technical issues) and will offer a rescheduling or full refund in such cases

8. Prohibited conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Transmit any fraudulent, misleading, or deceptive content
• Attempt to gain unauthorised access to any part of the Platform or its systems
• Interfere with the proper working of the Platform
• Scrape, data-mine, or extract data from the Platform without our written consent
• Impersonate any person or entity

9. Intellectual property

All content on the Platform, including text, graphics, logos, images, and software, is the property of MyYacht or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of liability

To the maximum extent permitted by applicable law, MyYacht shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any bookings made through it. Our total liability to you for any claim arising in connection with these Terms shall not exceed the amount paid by you for the specific booking giving rise to the claim.

11. Disclaimer of warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Governing law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.

13. Changes to these Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
